Experts seeking to testify in court about
extreme-influence processes practiced by clever
influencers against susceptible and vulnerable
influencees have encountered difficulty from
some judges who have hesitated or refused to
hear testimony about brainwashing, mind
control, and thought reform on the grounds that,
in their opinion, these concepts lack scientific
validity. This paper suggests that the legal
concept of undue influence be used as a vehicle
for such testimony. The paper also provides a
Social Influence Model (SIM) to assist an expert
in presenting the extensive science of social
influence to judges and jurors.

Los expertos que tratan de testificar en un
tribunal acerca de la influencia extrema ejercida
por manipuladores inteligentes en
personalidades sugestionables y vulnerables han
tenido dificultades con jueces que han dudado o
rechazado escuchar testimonios acerca del
lavado de cerebro, control mental y reforma del
pensamiento sobre la base de que estos
conceptos carecen de validez científica. Este
artículo sugiere que en estos casos se use el
concepto legal de influencia indebida. También
se ofrece un Modelo de Influencia Social (SIM,
por sus siglas en inglés) que ayude a los expertos
a mostrar a jueces y juristas una ciencia
adicional de influencia social.

Des experts qui interviennent devant les
tribunaux pour expliquer les mécanismes
d'emprise mis en place par des manipulateurs
intelligents sur des personnes influençables et
vulnérables ont été confrontés aux hésitations,
voire aux refus de certains juges d'écouter leurs
témoignages relatifs au lavage de cerveau, à la
manipulation mentale, à la réforme de la pensée,
au motif que ces notions manqueraient de crédit
scientifique. Cet article défend l'idée qu'il vaut
mieux se référer au concept juridique d'abus de
faiblesse pour évoquer de tels témoignages. Il
fournit également un Modèle d'Influence Sociale
(SIM :Social Influence Model) pour aider les
experts à présenter à des juges et à des jurés les
connaissances scientifiques sur les phénomènes
d'emprise.

tribunali sui processi di influenza praticata da
abili manipolatori su persone sensibili e
vulnerabili, hanno incontrato difficoltà perchè
alcuni giudici hanno esitato o hanno rifiutato di
ascoltare le testimonianze sul lavaggio del
cervello, il controllo mentale, o la riforma del
pensiero per il fatto che questi concetti
mancassero di validità scientifica. Questo lavoro
suggerisce che il concetto giuridico di indebita

skrajnych form oddziaływania praktykowanych
przez jednostki chytrze wywierające wpływ na
osoby wrażliwe i podatne na zranienia
napotykały trudności ze strony sędziów, którzy
wahali się lub odmawiali wysłuchania zeznań na
temat prania mózgu, kontroli umysłu i reformy
myśli, tłumacząc, iż pojęcia te nie mają
uzasadnienia naukowego. W niniejszym artykule
zasugerowano, aby prawnicze pojęcia odnoszące
się do bezprawnego nacisku były stosowane
jako pretekst do takich zeznań. Zaprezentowano
również model wpływu społecznego (Social
Influence Model, SIM), który pomógłby
ekspertom w przedstawieniu sędziom i
ławnikom rozległej nauki o wpływie
społecznym.
State Intervention Against The Baptist
Church of Windsor: From Law- Abiding
Citizens to Perpetrators of Severe Child
Physical Abuse

Based on a case study, this article presents the
evolution of The Baptist church of Windsor
towards an authoritarian and cult-type
functioning wherein, isolated from their social
environment, members resorted to severe child
physical abuse. An exhaustive analysis of
documents, testimonies of former members and
interviews with key participants point to the
leader as having played an important role in the
group’s evolution. The group’s trajectory from
its origin to its dissolution is presented and
described with an emphasis on the role played
by the leader and on the group’s struggles with
the law and with social-control agencies.
Finally, issues raised concerning the process of
victimization of the children and the choice of
intervention by social-control agencies are
discussed.

baptiste de Windsor: comment des citoyens
respectueux des lois sont devenus les auteurs de
graves agressions physiques sur des enfants

Cet article vise, par une analyse de cas unique, à
étudier l’évolution d’un groupe religieux
minoritaire, l’Église baptiste de Windsor, vers
un fonctionnement sectaire particulier, qui
l’isola de son environnement social et donna lieu
à une grave situation de violence contre des
mineurs. Une analyse documentaire exhaustive à
laquelle se sont ajoutés des témoignages
d’anciens membres du groupe ainsi que des
entretiens avec des informateurs-clés permet
d’observer le rôle prédominant joué par le
pasteur dans l’évolution du groupe. La
trajectoire du groupe, de sa fondation à sa
dissolution, sera décrite et discutée à la lumière
du rôle joué par le leader dans les conflits vécus
par le groupe avec la loi et avec les agences de
contrôle social. Enfin, le processus qui a conduit
à la victimisation des enfants ainsi que la
stratégie d’intervention à laquelle les agences de
contrôle social ont eu recours seront discutés.

Windsor: de ciudadanos respetuosos con la ley a
responsables de graves abusos físicos a menores

Basado en un estudio de caso, este artículo
presenta la evolución de la Iglesia Baptista de
Windsor hacia un funcionamiento autoritario de
tipo sectario. Aislados de su entorno social, sus
miembros han incurrido en graves abusos físicos
a menores. Un análisis exhaustivo de
documentación, testimonios, ex miembros y
entrevistas con participantes clave revela la
responsabilidad del líder al haber desempeñado
un importante papel en la transformación de la
comunidad. Se describe la trayectoria del grupo
